FAQ

Questions from international clients

Can you handle my case if I am outside Indonesia?

Yes, for matters governed by Indonesian law or heard by Indonesian courts. You can start with an online consultation. If we need to act for you, you sign a power of attorney abroad and have it legalised by an Indonesian embassy or consulate, or apostilled if your country is a party to the Apostille Convention.

Can you represent me in a court outside Indonesia?

No. An Indonesian advocate's area of practice is the territory of the Republic of Indonesia (Article 5(2) of Law No. 18 of 2003 on Advocates). For proceedings abroad, we can help you prepare Indonesian documents and coordinate with a lawyer qualified in that country.

Can a foreigner own land or a house in Indonesia?

A foreign national cannot hold freehold title (Hak Milik). A foreigner who acquires it through a marriage property regime must release it within one year (Article 21(3) of the Basic Agrarian Law). Other rights, such as the right of use (Hak Pakai), are available under separate rules. Get advice before you buy or marry without a prenuptial agreement.

How do I divorce my Indonesian spouse if one of us lives abroad?

Divorce must be decided by an Indonesian court. When the respondent lives abroad, the summons is delivered through the Indonesian mission, and the hearing is scheduled at least six months after filing (Articles 20, 28 and 29 of Government Regulation No. 9 of 1975). For Muslim couples, the Religious Court has jurisdiction.

Can you guarantee the outcome of my case?

No. The Indonesian Advocates' Code of Ethics prohibits advocates from guaranteeing that a case will be won (Article 4(c)). We give you an honest assessment of your legal position and work diligently within the law.

Which language will the consultation be in?

Write to us in English or Indonesian and tell us your preferred language. We will confirm how the consultation can be conducted. If needed, an interpreter or sworn translator can be arranged at your cost.
